We recognize the importance of protecting and securing Personal Data and are committed to ensuring that Personal Data collected by us is used appropriately, securely, and in compliance with applicable Personal Data protection laws. We have established this Personal Data Protection Policy (this “Policy”) to inform you, as a data subject, of the purposes and details of the collection, use, and/or disclosure of your Personal Data, as well as your rights under applicable laws.
Article 1. Introduction
1.1 Who are we?
We are Minto (Thailand) Co., Ltd., a company incorporated under the laws of Thailand under registration number 0105562052881, having its registered office at 1126/1 Vanit 1 Building, 10th Floor, Room 1006, Phetchaburi Road, Makkasan, Ratchathewi, Bangkok 10400, Thailand.
1.2 What is Personal Data?
In this Policy, “Personal Data” means information relating to a natural person, which is identified or identifiable, whether directly or indirectly, but excluding information of deceased natural persons. Please note that at all times we will adhere to the applicable statutory definition in determining what information is and is not Personal Data for the purposes of this Privacy Policy.
Article 2. To whom will this Policy apply?
This Policy shall apply to you if you are classified as one or several types of the following persons.
(a) Users, Clients, or Business Counterparties
Individuals who use, have used, or interact with our products, services, websites, applications, platforms, or other offerings, whether on a paid or unpaid basis, including those who request information, receive proposals, participate in trials, or are contacted for marketing or business purposes.
(b) Individuals Related to Juristic Persons
Individuals who are associated with a juristic person that has a business relationship or conducts transactions with us, including but not limited to:

(c) Individuals Involved in Transactions or Interactions

- any other individuals of a similar nature

Other individuals with whom we have a relationship, interaction, or contact, or whose Personal Data we obtain or receive, whether directly or indirectly, through any channel.
Article 3. Channel for the collection of Personal Data
We may collect your Personal Data via the following channels:
(a) The Personal Data that you provide directly to us or through our services, or that is collected and held by us as a result of your use of our websites, web services, applications, platforms, or other services, as well as through your interactions, communications, visits, registrations, participation in activities, searches, or other engagements via our service channels, including but not limited to our websites, applications, online platforms, online social media accounts, email, telephone, electronic forms, surveys, questionnaires, messaging services (such as SMS or in-app messages), meetings, online or offline events, seminars, training sessions, marketing or promotional activities, customer support channels, or any other communication or interaction channels made available by us.
(b) The Personal Data that we receive or access from other sources, such as government authorities, public agencies, our group companies or affiliates, business partners, service providers, subcontractors, joint service or product providers, data processors, marketing partners, analytics providers, information service providers, social media platforms, third-party online platforms, publicly available sources (such as official registries or publications), individuals or entities involved in transactions or interactions with you, persons having legal authority or rights, or any other persons or organizations with whom we have a legal or contractual relationship, as permitted by applicable laws.
Article 4. Types of Personal Data Collected, Used, and/or Disclosed
4.1 We collect the following information about you:
(a) Personal Information

- Nationality, country of residence
- Signature (including electronic signature)
- Information contained in documents issued by government authorities or used for identification and verification purposes (such as national ID card, passport, visa, work permit, residence certificate, house registration, birth certificate, name change certificate, marriage or divorce certificate, driving license, or similar identification documents), and other identity verification or due diligence data, as permitted by law.

- Tax identification number and tax-related information, where required by law
- Transaction records, transaction history, transaction references, transaction channels, and transaction purposes
- Other information necessary to support the provision, operation, billing, or improvement of our products and services

- Logs or records generated through automated systems, chatbots, or similar tools
- Information related to legal obligations, regulatory requirements, or official orders (such as court orders or government notices), where applicable
- Information related to registration for or participation in activities, campaigns, events, or promotions organized by us
Article 5. Special Categories of Personal Data
5.1 Sensitive Personal Data
“Sensitive Personal Data” means Personal Data that is designated as sensitive Personal Data under applicable Personal Data protection laws. We do not collect, use, or disclose Sensitive Personal Data. Where a document you provide to us for identity verification happens to show Sensitive Personal Data that we do not require, such as religion or blood group shown on a national identification card, we ask you to redact it before providing the document, and we may redact it ourselves. If in future we need to collect, use, or disclose Sensitive Personal Data, we will do so only with your explicit consent or where otherwise permitted or required by applicable laws, and only to the extent necessary for the relevant purpose. (Unless specifically stated otherwise, Personal Data and Sensitive Personal Data as earlier mentioned shall hereinafter be collectively referred to as “Personal Data”.)
5.2 Personal Data of Minors and Legally Incapacitated Persons
We do not intend to knowingly collect, use, or disclose Personal Data of minors, legally incompetent persons, or quasi-incompetent persons, unless:
(a) consent has been obtained from a parent, legal guardian, appointed guardian, or curator, as required by applicable laws; and/or
(b) the minor is legally permitted to give consent on their own; or
(c) another lawful basis for processing applies under applicable laws.
If we become aware that we have collected, used, or disclosed Personal Data of minors, legally incompetent persons, or quasi-incompetent persons without the required consent or other lawful basis, we will take appropriate steps to delete, destroy, or anonymize such Personal Data without undue delay, in accordance with applicable laws.
5.3 Personal Data of Third Parties
In certain circumstances, you may provide us with Personal Data of third parties, such as individuals associated with you or with a juristic person, including shareholders, directors, authorized representatives, employees, family members, reference persons, business partners, guarantors, beneficiaries, emergency contacts, or other relevant persons. Where you provide us with Personal Data of any third party, you represent and warrant that you have informed such third party of the details of this Policy and have obtained any necessary consent or have another lawful basis for providing such Personal Data to us, in accordance with applicable laws. We will collect, use, and/or disclose such third-party Personal Data only for the purposes described in this Policy and in compliance with applicable Personal Data protection laws.
Article 6. Collection, Use, and/or Disclosure of Personal Data
6.1 We will collect, use, and/or disclose your Personal Data only to the extent necessary for legitimate business purposes and in accordance with applicable Personal Data protection laws. Such purposes may include the performance of contracts to which you are a party, compliance with legal obligations, the pursuit of our legitimate interests, operations based on your consent, and/or other lawful bases permitted under applicable laws.
6.2 Where the collection, use, or disclosure of Personal Data is necessary for the performance of a contract, compliance with legal obligations, or the provision of our products or services, failure to provide such Personal Data upon request may result in our inability to enter into or perform a contract, provide certain products or services, or continue the relevant relationship, in whole or in part.
6.3 In some engagements we act as a data processor on behalf of our client, who is the data controller. In those engagements we collect, use, and disclose Personal Data only in accordance with our client’s instructions and the data processing agreement we have entered into with that client, and not for our own purposes. Where we act as a data processor, the privacy notice of the relevant data controller governs the processing, and you should direct requests concerning your Personal Data to that data controller.
Article 7. Objectives Requiring Consent
We will collect, use, and/or disclose your Personal Data based on your consent where required by applicable laws, including for the following purposes:
(a) Research, Analysis, and Development.
Conducting research, analysis, or statistical studies for the development, improvement, or enhancement of our products, services, systems, or business operations, where consent is required by law.
(b) Marketing and Communications
Conducting marketing activities, providing information, offers, promotions, benefits, events, or communications relating to our products or services, including those of our Affiliates or business partners, where consent is required under applicable laws.
(c) Location or Device-Based Processing
Use of location data, device identifiers, or similar technologies for purposes such as service optimization, security, fraud prevention, or collections-related activities, where consent is required by applicable laws.
(d) Website Analytics and Advertising Measurement
Using analytics and advertising cookies on our website minto-th.com, including Google Analytics 4 and Google Ads, to analyze how visitors use the website and to measure the effectiveness of our advertising.
We may request your consent directly or through our Affiliates, business partners, or service providers, on a case-by-case basis and in accordance with applicable laws.
Article 8. Objectives Based on Other Lawful Bases
We may collect, use, and/or disclose your Personal Data without relying on consent, where permitted by applicable laws, based on other lawful bases such as contractual necessity, legal obligation, legitimate interests, or other lawful grounds, for the following purposes:

Such processing shall be conducted in a manner that does not result in decisions producing legal effects concerning you or similarly significant effects, unless otherwise permitted by applicable laws or based on your consent. This purpose does not include the use of analytics or advertising cookies on our website, which we use only with your consent.

Article 9. To Whom Will Your Personal Data Be Disclosed?
9.1 Subject to your consent or where otherwise permitted or required by applicable laws, we may disclose your Personal Data to third parties. Any recipient of your Personal Data will collect, use, and/or disclose such Personal Data only within the scope of the purposes for which consent has been given or as otherwise permitted under this Policy and applicable laws. In certain cases, the recipient of your Personal Data may be subject to its own privacy or Personal Data protection policies. Such recipients may be located in Thailand or in other countries.
9.2 We may disclose your Personal Data to the following categories of persons or entities, depending on the nature of your relationship, interaction, or transactions with us:
(a) Affiliates and Group Companies
Our affiliates, subsidiaries, parent companies, or other companies within the same corporate group, for purposes consistent with this Policy or based on your consent, where applicable. Such entities may rely on the consent obtained by us, to the extent permitted by applicable laws.
(b) Service Providers and Data Processors
Third-party service providers, contractors, agents, or subcontractors, whether located in Thailand or abroad, who perform services on our behalf or support our business operations, including but not limited to:

- Marketing, advertising, and communications service providers
- Customer support and contact center service providers

Such service providers will process Personal Data only in accordance with our instructions and applicable laws, and will be subject to appropriate contractual and security obligations.
(c) Business Partners
Business partners with whom we jointly provide products, services, promotions, campaigns, or activities, including co-branding or collaborative arrangements. Where your Personal Data is disclosed to business partners for their own marketing or promotional purposes, we will obtain your consent or otherwise ensure a lawful basis, and may inform you of the relevant business partners, as required by applicable laws. Such business partners may rely on the consent obtained by us, where permitted. This includes rights holders of the characters you are interested in, including rights holders located in Japan, where necessary to propose or arrange a license or project you have requested. Before we send your Personal Data to a rights holder outside Thailand, we will ask for your consent.
(d) Legal and Regulatory Authorities
Government authorities, regulators, courts, law enforcement agencies, or other competent authorities, where disclosure is required or permitted by applicable laws, regulations, legal processes, or enforceable governmental requests, including for the purposes of:
- compliance with laws or regulatory obligations
- responding to court orders, subpoenas, or official requests
- protection of our legal rights, property, or interests, or those of third parties
(e) Professional Advisors
Professional advisors or experts engaged by us in connection with our business operations, including:
- legal advisors
- auditors or external auditors
- tax advisors
- consultants or other professional experts
(f) Corporate Transactions and Business Transfers
In the event of a merger, acquisition, reorganization, restructuring, business transfer, assignment of rights or obligations, or similar corporate transaction, we may disclose your Personal Data to prospective or actual counterparties, investors, purchasers, or their advisors, subject to appropriate safeguards and applicable laws.
(g) Other Third Parties
Other third parties where necessary for the purposes described in this Policy or as otherwise permitted by applicable laws, including but not limited to:
- persons or entities with whom you have a contractual or transactional relationship in connection with our business
- technology partners or platform providers
- educational or research institutions
- social media platforms or online service providers
- members of the public, where disclosure is required by law or necessary for public interest purposes
Article 10. Cross-Border Transfer of Personal Data
10.1 We send or transfer Personal Data outside Thailand only in the following cases:
(a) Minto Inc. (Japan). We may share your inquiry details with our parent company, Minto Inc., where necessary to respond to your inquiry or deliver services. These transfers are made under a data transfer agreement between Minto Thailand and Minto Inc. that provides the safeguards required under applicable Personal Data protection laws.
(b) Google LLC (United States). Data collected by Google Analytics and Google Ads cookies is transferred to Google LLC in the United States only if you accept those cookies through our cookie banner. The United States may not provide a level of Personal Data protection equivalent to that required under Thai law. The cookie banner explains this transfer, and by accepting analytics or advertising cookies you consent to it.
(c) Rights holders outside Thailand. Before we send your Personal Data to a rights holder located outside Thailand, we will tell you the recipient and the country, and we will ask for your consent.
10.2 Personal Data relating to projects we carry out in Thailand for our clients is stored in Thailand and is not transferred to any other country.
10.3 If we send or transfer your Personal Data outside Thailand, and the destination country does not provide a level of Personal Data protection equivalent to that required under applicable laws, we will ensure that appropriate safeguards are implemented to protect your Personal Data, in accordance with applicable Personal Data protection laws. Such safeguards may include, as appropriate:
(a) entering into contractual agreements with data recipients that impose Personal Data protection standards equivalent to those required under applicable laws
(b) implementing internal data protection policies or binding corporate rules for intra-group transfers
(c) relying on other mechanisms recognized or permitted by applicable laws
10.4 We will take reasonable steps to ensure that recipients of your Personal Data outside the relevant jurisdiction process such Personal Data securely and in compliance with applicable laws and this Policy.
Article 11. Use of Cookies and Similar Technologies
11.1 We may collect and use cookies and/or similar technologies when you access or use our websites, applications, platforms, or digital services, including through the internet or other electronic networks. Cookies and similar technologies (such as web beacons, pixels, SDKs, or other tracking technologies) may be used to:

(b) analyze how our websites, applications, or services are accessed and used
(c) improve the performance, functionality, security, and user experience of our digital services
(d) develop, maintain, and enhance our products, services, and systems
(e) support analytics, measurement, and reporting activities

(a) strictly necessary cookies, which are required for the website to function and to keep it secure, for example security and language settings;
(b) analytics cookies, through Google Analytics 4, which help us understand how visitors use the website, and Google Analytics may retain data for up to 14 months; and
(c) advertising cookies, through Google Ads, which help us measure whether our advertisements lead to inquiries.
11.3 We use analytics and advertising cookies only if you accept them through the cookie banner on our website. You may withdraw your consent at any time through the cookie settings link at the bottom of each page. You can also refuse or delete cookies through your browser settings, opt out of Google Analytics by installing the Google Analytics Opt-out Browser Add-on, and manage personalized advertising on Google’s Ad Settings page.
11.4 We may use third-party analytics, measurement, or technology service providers to assist us in understanding how our digital services are used. Such service providers may use cookies, SDKs, or similar technologies to collect information about your interactions with our websites, applications, or services. The information shared with such third-party service providers may include aggregated or de-identified data, or other information processed in accordance with applicable laws. These service providers will process such data in accordance with their own privacy policies and applicable laws.
Article 12. How long do we store your Personal Data?
12.1 We will retain your Personal Data only for as long as necessary to fulfill the purposes described in this Policy, during the period in which you have a relationship, interaction, or engagement with us, or as otherwise required or permitted by applicable laws.
12.2 Once the relevant relationship, interaction, or engagement has ended, we may continue to retain your Personal Data for an additional period as necessary to comply with applicable laws and regulations, contractual obligations, or statutes of limitation, or to establish, exercise, or defend legal claims.
12.3 Without prejudice to the foregoing, Personal Data may be retained for the following periods, where applicable:
(a) for a period of not less than 5 years from the date of closing of accounts, in the case of accounting records the documents required to support accounting entries, as required by the Accounting Act B.E. 2543 (2000); and
(b) for a period of not less than 5 years from the date of filing the tax return, in the case of tax invoices and related tax documents, as required by the Revenue Code;
(c) for up to 3 years after our last communication, in the case of inquiries that do not lead to a contract;
(d) for up to 14 months, in the case of website analytics data;
(e) for up to 10 years, which is the general limitation period under the Civil and Commercial Code, where needed to establish, exercise, or defend legal claims; and
(f) for the period specified in the relevant contract, where a contract requires us to delete or return Personal Data on completion of a project or on termination.
The applicable retention period may vary depending on the category of Personal Data, the purpose of processing, and the relevant legal or regulatory requirements.
12.4 When Personal Data is no longer necessary for the purposes for which it was collected, or when the applicable retention period expires, we will take appropriate measures to delete, destroy, or anonymize such Personal Data, in accordance with applicable laws and our internal data retention policies.
Article 13. How Do We Protect Your Personal Data?
13.1 We implement appropriate technical, administrative, and physical security measures to safeguard your Personal Data, in order to maintain its confidentiality, integrity, accuracy, and availability, and to prevent unauthorized or unlawful access, collection, use, disclosure, alteration, or loss of Personal Data, in accordance with applicable laws.
13.2 We have established and maintain internal policies, procedures, and standards for Personal Data protection, which may include, as appropriate:
(a) anti-malware and antivirus software on the systems used to process Personal Data
(b) storage of Personal Data on our organization’s Google Workspace environment, accessible only by our personnel, with external sharing disabled
(c) restriction of access to each project’s Personal Data to the personnel involved in that project
(d) restriction of access to Personal Data on a need-to-know basis, with access rights assigned to authorized personnel
(e) automated breach and anomaly alerts generated by our Google Workspace environment
(f) written confidentiality undertakings in our employment contracts, together with an acceptable use policy for our information technology systems, and internal guidance on handling untrusted files
13.3 These measures are designed to be appropriate to the nature of the Personal Data, the purposes of processing, and the risks involved, and may be updated from time to time to reflect changes in technology, business operations, or legal requirements.
Article 14. Your Rights as a Data Subject
14.1 Subject to applicable Personal Data protection laws, you have certain rights in relation to your Personal Data. You may exercise these rights in accordance with the procedures, conditions, and limitations prescribed by applicable laws. Where you are a minor or lack legal capacity under applicable laws, your parent, legal guardian, or authorized representative may exercise these rights on your behalf.
(a) Right to Withdraw Consent (opt-out)
Where we rely on your consent to collect, use, or disclose your Personal Data, you have the right to withdraw such consent at any time, unless restricted by applicable laws or where the processing is necessary for the performance of a contract or other lawful purposes. Withdrawal of consent will not affect the lawfulness of processing carried out prior to such withdrawal. However, withdrawal of consent may result in our inability to provide certain products or services, in whole or in part.
(b) Right of Access
You have the right to request access to your Personal Data under our control and to request a copy of such Personal Data, as well as information on how such Personal Data has been collected, used, or disclosed, subject to applicable laws.
(c) Right to Data Portability
Where permitted by applicable laws, you have the right to request that your Personal Data be provided to you in a structured, commonly used, and machine-readable format, and to request that such Personal Data be transmitted to another data controller, where technically feasible.
(d) Right to Object

- such Personal Data is no longer necessary for the purposes for which it was collected;
- the processing is unlawful;

(h) Right to Lodge a Complaint
You have the right to lodge a complaint with the Personal Data Protection Committee of Thailand if you believe that the collection, use, or disclosure of your Personal Data does not comply with applicable Personal Data protection laws.
14.2 The exercise of the above rights may be subject to limitations, conditions, or exceptions under applicable laws. In certain circumstances, we may be required or permitted by law to refuse or restrict the exercise of certain rights, such as where compliance would adversely affect the rights or freedoms of others, public interest, legal obligations, or the establishment, exercise, or defense of legal claims. Where we are unable to comply with your request, we will inform you of the reasons, to the extent required by applicable laws.
Article 15. Policy Updates and Amendments
15.1 We may review, update, amend, or revise this Policy from time to time, as deemed necessary or appropriate, to reflect changes in applicable laws, regulations, business operations, or internal practices.
15.2 Where required by applicable laws, we will notify you of any material changes to this Policy through appropriate channels, such as by posting the updated Policy on our website, application, or other communication channels, or by providing direct notice to you.
15.3 The updated version of this Policy will become effective as of the date specified in the revised Policy, unless otherwise required by applicable laws.
Article 16. Language
